We view mediation as a voluntary process in which the parties make decisions together based on their understanding of their own views, each other's and the reality they face. Mediation is voluntary and non-binding unless an agreement is reached, and often gives the parties the opportunity to air and resolve their dispute while saving their relationship.

While Scott Flegal has been mediating cases since 1998, he has acquired the bulk of his mediation skills at the Harvard Law School Program of Instruction for Lawyers. In 2004, he completed an advanced mediation workshop taught by Professor Robert Mnookin, the Chair of the Harvard Negotiation Project, and mediation pioneer Gary Friedman. In that workshop Attorney Flegal was trained in the "Understanding-based Mediation Model", a mediation model in which all parties to the case remain in the same room and work with the mediator to develop a solution to the problem at hand. In 2005, he completed a second advanced negotiation workshop at the Harvard Law School Program of Instruction for Lawyers taught by Harvard Law School professors Sheila Heen, Douglas Stone and Bruce Patton called "Advanced Negotiations: Understanding and Managing Difficult Conversations". That workshop focused on one of the most difficult aspects of any negotiation: managing the interpersonal issues that so often make negotiated resolution difficult if not impossible. In 2007, he completed "Teaching Negotiation in the Organization", a course offered by the Harvard Program on Negotiation, and taught by professor Lawrence Susskind, Ford Professor of Urban and Environmental Planning at MIT and President of the Consensus Building Institute.
